PRIVACY POLICY
1. DEFINITIONS
When applying this privacy policy, the following terms and expressions are used in the following meaning:
- Supplier – Athletic Fitness Ltd., with its registered office and registered office in Sofia, 78 Yanko Sakazov Blvd., registered in the Commercial Register at the Registry Agency with UIC 121616204; VAT registration: BG121616204; identification number in the Electronic Register of Personal Data Administrators at the Commission for Personal Data Protection: 129733;
- AthleticFitness.bg – an electronic store owned by Athletic Fitness, accessible at the Internet address www.athletic.bg, through which customers have the opportunity to conclude contracts (agreements) for the purchase and sale of the services offered by the electronic store;
- User – any person who has registered in accordance with this Privacy Policy and has an active user profile for using the e-store;
- User profile – created upon completion of registration and separated in the database of the e-store, a unique profile of the respective client for use of AthleticFitness.bg, accessible by entering a username and password;
- Services – fitness services offered by Athletic Fitness in the chain's locations.
2. APPLICABILITY
The Provider acts as the administrator of personal data collected and processed in connection with the provision of the services and activities of the e-store AthleticFitness.bg.
By checking the appropriate box upon completion of registration, each new user declares that they are familiar with this Privacy Policy and agree to its contents with respect to any use of the online store for the period of activity of their user profile. This privacy policy is available on the website Privacy Policy.
In addition to accepting this Privacy Policy, the User is also bound by the General Terms and Conditions and the Terms and Conditions of Athletic Fitness.
In case the User is a minor, by checking the appropriate box to confirm acceptance of this Privacy Policy and completing the registration, he declares the knowledge and consent of his parents or guardians to accept this Privacy Policy and complete the registration. In case the User is a minor, the statement of familiarization with and acceptance of this Privacy Policy is made by a parent or guardian.
Declaring familiarity with and acceptance of this Privacy Policy by checking the relevant box and submitting the registration form by clicking the relevant button constitutes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act.
Upon registration and upon subsequent updating, the User, or his/her parent or guardian, declares that the provided identity data is accurate, true and complete.
The Provider does not collect and process data of minors and minors when it knows that the necessary consent for this has not been given in the manner specified above.
3. TYPES OF PERSONAL DATA, METHODS OF COLLECTION, PURPOSES OF USE
The Provider collects and processes personal data of its users. This information includes data that users provide when registering or updating their user profile, such as names, e-mail address, telephone number, photo, as well as any other information that the Provider deems necessary. This personal data is the property of each respective User.
The Provider uses the consent given during the registration process as a legal basis for collecting and processing the personal data of individual users. The provision of the requested data is a necessary condition for the conclusion of a contract between the parties, as without this data the Provider cannot fulfill its obligations under it.
The Provider strives to limit the collection of personal data to the minimum necessary to provide its users with the services they have requested. Without access to this minimum of personal data, Athletic Fitness cannot offer its services to its potential users.
The protection of the personal data of its users is of utmost importance to the Provider. Although the Provider cannot guarantee complete security, the Provider takes internal technical and organizational measures to protect the personal data of its users against unauthorized access by third parties.
The Provider processes personal data within the framework of the consent provided by the users for the purpose of providing the services requested by the users, such as providing the requested services, for communication with the users, for direct marketing or for statistical purposes, for informing the users about current initiatives of Athletic Fitness, as well as for the overall improvement of the quality of the services offered. The Provider does not perform automated decision-making or profiling.
The Provider does not use personal data for purposes other than those specified.
4. WHO AND WHY DO WE SHARE YOUR PERSONAL DATA?
The Provider does not share personal data with third parties or provide them with access to them, except in the following cases:
- With the consent of the relevant User;
- When this is strictly necessary to provide a service requested by a User, such as when making a payment through an external payment service provider, in which cases the Provider strives to provide no more than the necessary minimum of personal data, as well as to ensure that these third parties make adequate efforts to protect the personal data of users;
- To protect its legal rights and interests, as well as those of its users;
- When the Provider is required by law to disclose such personal data.
5. STORAGE OF YOUR PERSONAL DATA
The Provider stores and otherwise processes the personal data of users in accordance with applicable European and local legislation. Data transfer to third countries within the meaning of and within the scope of Regulation (EU) 2016/679 is carried out in compliance with the requirements specified in this Regulation.
The Provider strives to retain personal data for the period of their processing in relation to the purposes for which they were collected. If necessary, the relevant personal data should be deleted within 6 months of establishing the lack of grounds/necessity for their retention, including from all archives, backup copies, databases of recipients of such personal data, etc.
The provider may store personal data in anonymized form for a longer period, for example for statistical purposes.
6. ACCESS TO PERSONAL DATA, CHANGE OF PERSONAL DATA
In case of inaccuracies, the User has the right to request in writing the updating of this personal data.
The user has the right to withdraw the consent given for the processing of his/her personal data and request their deletion in writing. In this case, the Provider will not have the minimum necessary information to continue providing the services of AthleticFitness.bg and the user profile of the respective user will be deleted.
The user also has the right to object to processing, as well as the right to data portability.
In case a user has questions regarding the described rights, wishes to receive information about or a copy of his/her personal data that the Provider stores and processes, he/she should send a request to the Provider in writing in one of the ways indicated below.
7. CHANGES TO THE PRIVACY POLICY
If necessary, the Provider has the right to unilaterally make amendments and/or additions to this privacy policy.
When making significant changes and/or additions to this privacy policy, the Provider notifies users, giving them a two-week period to familiarize themselves with the changes.
Within the two-week period provided to them, users may state by express written notice to the Provider that they do not accept the amendments and/or additions to the privacy policy. In such a case, the respective user profile shall be closed and the relationship between the parties shall be terminated.
If the consumer does not explicitly object within the two-week period, it is deemed that he accepts the amendments and/or supplements and they shall be effective in the relations between the parties and shall bind them in the future.
8. DISPUTE RESOLUTION, OTHER PROVISIONS
In case of disagreement on the part of a user with these practices, the Provider encourages the user to contact a company representative directly, using one of the contact options listed below, in order to attempt to informally resolve the disputes that have arisen. In case the User does not wish to use this method or is not satisfied with the Provider's response, the User has the right to refer the matter to the Personal Data Protection Commission.
For situations not regulated in this privacy policy, the General Terms and Conditions, the general provisions of Bulgarian and relevant applicable international legislation apply.
The invalidity of any provision of this Privacy Policy shall not result in the invalidity of the Privacy Policy in its entirety.
